services provided by ConcordNet may be used for lawful purposes
only. The transmission, storage or presentation of any information,
data or material in violation of any law is prohibited. This
includes, but is not limited to, copyrighted material, material we
judge to be threatening or obscene or material protected by trade
secret or other statute.
2.2 The customer agrees
to indemnify and hold harmless ConcordNet from any claims resulting
from the use of the website hosting service that damages the
customer or any other party
3.0 Copyright and Trade Mark Violations
3.1 Website hosting
customers must not engage in any activity that infringes or
misappropriates the intellectual property rights of others,
including copyrights, trademarks, service marks, trade secrets,
software piracy, and patents held by individuals, corporations, or
other entities.
4.0
The Privacy and Rights of Others
4.1 As a ConcordNet
website hosting customers a person must not engage in any activity
that violates the rights of others. Using ConcordNet’s web hosting
network in violation of privacy statutes, or the transmission,
displaying or otherwise making available obscene or abusive speech
or material is strictly prohibited.

The Transmission of Bulk Email
5.1 The use of
ConcordNet’s web hosting services for the transmission of
unsolicited bulk emails or commercial messages over the Internet is
prohibited This transmission (spamming) can degrade and interrupt
the services offered by ConcordNet When a “bulk email” incident
occurs the customer shall provide evidence acceptable to ConcordNet
that the emails transmitted were from an “opt in” email list.
6.0
Refusal of Service
6.1 ConcordNet reserves
the right, at the sole discretion of the company, to cancel or
refuse web hosting services for violation of the conditions of the
ConcordNet website hosting policies.
7.0
Customer Indemnifies ConcordNet
7.1 The Customer agrees
that it shall defend, indemnify, save and hold Concordnet harmless
from any and all demands, liabilities, losses, costs and claims,
including reasonable legal fees asserted against ConcordNet, its
agents, its customers, officers and employees, that may arise or
result from any service provided or performed or agreed to be
performed or any product sold by the customer, it's agents,
employees or assignees. The ConcordNet Customer agrees to defend,
indemnify and hold harmless ConcordNet against liabilities arising
out of; (1) any injury to person or property caused by any products
sold or otherwise distributed in connection with ConcordNet servers;
(2) any material supplied by customer infringing or allegedly
infringing on the proprietary rights of a third party and (3)
copyright infringement.
8.0
Disclaimer
8.1 ConcordNet will not
be responsible for any damages your business may suffer.
Additionally, ConcordNet makes no warranties of any kind, expressed
or implied for services we provide. ConcordNet disclaims any
warranty or merchantability or fitness for a particular purpose.
This includes loss of data resulting from delays, and any and all
service interruptions caused by ConcordNet and its employees.
